Terms of use

Service — the finmarket.kg website, its subdomains and the FinMarketKG mobile app.

User — an individual aged 18 or over, or a representative of a legal entity, using the Service.

Partner — a bank, microfinance organisation, insurer or other organisation whose products are listed in the Service under a contract with the Administration.

Application — the data the User voluntarily submits via the Service to obtain a Partner's product.

The Administration gives the User free access to information about Partners' financial products, calculators, exchange rates, reviews and Journal articles, and the ability to send an Application to a Partner.

The Service is an information intermediary. The Administration is not a bank, a microfinance or insurance organisation, does not provide financial services and does not decide on Applications. Information in the Service is not a public offer within the meaning of Article 397 of the Civil Code.

The User undertakes to:

• provide accurate data when submitting an Application;
• not use the Service for unlawful purposes, including fraud and spam;
• not copy the Service's databases by automated means without the Administration's written permission;
• not post knowingly false statements or insults in reviews.

The User may withdraw consent to personal data processing at any time by e-mailing privacy@finmarket.kg, and may delete the account in the personal dashboard.

By sending an Application the User instructs the Administration to transfer the specified data to the chosen Partner. Product terms (rate, term, fees, premium) are set by the Partner and may differ from those shown in the Service; the actual terms are fixed in the contract with the Partner.

The Administration is not liable for a Partner's refusal, processing times or service quality. Claims about Partner products are addressed to the Partner and, where consumer rights are violated, to the NBKR, the State Financial Supervision Service or the antimonopoly agency under the Kyrgyz Law on Consumer Protection.

By posting a review the User grants the Administration a non-exclusive right to use its text in the Service and marketing materials without remuneration. The Administration may moderate reviews, decline material with signs of advertising, insults or false statements, and remove it at the reasoned request of a Partner or public authority.

The FinMarketKG trademark, design, source code, Journal texts and databases are protected by the Kyrgyz Laws on Copyright and Related Rights and on Trademarks. Journal materials may be quoted with an active link to the source, up to 30% of the material.

The Service is provided 'as is'. The Administration strives to keep data current but does not guarantee the absence of errors in rates, exchange rates and calculator results. NBKR rates are published from nbkr.kg; bank rates come from Partners and may differ from those in branches.

The Administration's aggregate liability to the User is limited to 10,000 som.

The Administration may amend the Terms by publishing a new version in the Service at least 7 days before it takes effect. Continued use of the Service constitutes acceptance. The User may stop using the Service at any time.

The Terms are governed by the law of the Kyrgyz Republic. Disputes are resolved by negotiation and, failing that, in court at the Administration's location: 125 Toktogul St., Bishkek. A pre-trial claim is mandatory; the response period is 10 business days.
